CA Commercial Property Owner Seeks Eviction Order Against Medical Marijuana Dispensary

Concourse Business Centre has asked the district court to issue an order barring one of California’s largest medical marijuana dispensaries from operating on its premises. Harborside Medical Centre, which has been featured on the television show, “Weed Wars,” has been renting space from Concourse since 2011. Concourse agreed to let the premises on the understanding that they would be used for an office and warehouse for an herbal supplement and medical cannabis dispensary.

Concourse claims that it understood Harborside was operating a legal business and “mistakenly believed that one could lawfully operate a medical cannabis dispensary in the State of California,” according to papers filed with the court. After the television show aired, the U.S. attorney’s office filed lawsuits against Harborside. The company claims to be the largest retailer of marijuana in the world and to have over 100,000 customers.

The commercial property owner has given Harborside 30 days’ notice to stop growing and selling the medical marijuana on the property. Despite on-going discussions to set a date for Harborside to move out of the property, the two sides have been unable to reach an agreement. Harborside has also refused to stop selling marijuana from the property.

Concourse is now asking for a court order to stop Harborside from using its property for “the cultivation, possession with intent to distribute, and/or distribution of marijuana in any form.” Harborside claims that is has complied with all state and local laws, and that it is not operating its business within 1,000 feet of a park, playground or school. A statement posted on the Harborside website states that the clinic will fight the eviction using all legal means at its disposal and that the clinic has nothing to be ashamed of.
